Meh. The article says the deep truth: Kiffin will do it and dare anyone to stop him. And no one will.

The source seems to be an Off3 reporter who covers Ole Miss so I'd hold off blaming Kiffin yet.

The rivalry between Ole Miss and LSU just got ratcheted up though, regardless.

Ok bad analogy so what about houses? If I buy a home and we sign a contract and then the sellers find a better bid and break the contract. What's the point paying to have that contract signed only to have it broken? I paid to have the contract signed. That's how this went down. Duke lost money just in the contract being signed, they had pay lawyers and now that Mensah signed with Miami, Duke is out that money. See what I'm saying? A contract should be binding, you break it, you pay. In some societies, breaking a contract was a death sentence.

I would assume the terms of your contract would be written to stipulate the penalty for breaking it, such as backing out of a house deal and losing your escrow. Legal contracts are binding, and generally the penalty to breaking them means breaking out your checkbook. And then you decide whether it's worth that cost or not. What we don't know are the terms of these contracts, how enforceable they are, and what the penalties are for breaking them. If the penalty is sufficiently less than the better offer elsewhere, it may seem worth it to pay out and go.

Likely the Washington contract was done with the Big Ten's model contract with processes they encouraged, so I expect that one is a good, binding contract. Duke's should be as well. If trying to break a contract remains a rare occurrence there isn't going to be fallout for the school from recruits if the school is paying market for players. If bolting after signing is seen by recruits as backstabbing, the lawsuits will go forward to stop this.

Agreed, but contracts are broken every day and is probably the number one reason we have a civil courts system. That still doesn't mean they should be broken, but some businesses will calculate the legal risk vs. the financial and choose which they believe will be least costly.

Make the penalty enough to stop them in their tracks.

That is what is evaluated in every case: Is the penalty less expensive/painful than the continuing to honor the contract will be. Simple math.

Yet our laws are so lax, no one is worried. Only in America. Cane these fools.
