Is the Judicial Branch now a Political Branch

    This morning I woke up to a letter sent to all members of the Florida Bar. It is authored by George Felos, a noted right to privacy lawyer. He opines that. The judicial branch has morphed into a purely political branch. The judges are appointed by politicians not based on merit, but based on ideological alignment. That is a broken system.

    No doubt, ever since roe v wade 50 years ago the right has been on a mission to stack the courts with judges who will rule in their favor; the scotus in particular but also at the state level.

    Thanks goodness we have the left who only nominate qualified judges that are completely impartial. Democrats will save our country from these terrible conservatives yet.

    Yes, it's called judge shopping for a reason.

    Unfortunately, the executive branch weaponized by the Biden administration against political opponents has only heightened the judicial branch having to rule on political decisions/actions.

    The US has been a banana republic since June 2016 when Hillary Clinton was allowed to skate because supposedly no jury would convict her for her wrongdoing.

    The SCOTUS will soon be ruling on political cases never before in history seen as the Biden administration has weaponized law enforcement and the judiciary through lawfare and threatens what is left of the republic, now a cross between a banana republic, globalism, and elements of socialism.

    Matters today are far worse than when Obama weaponized the IRS and targeted the Tea Party. The Biden administration has dragged the judicial branch into lawfare at a level that is historic and never before seen in the US. There are lots of reasons to vote Biden out, but this one is at the top of my list as the country cannot stand long term with a two-tiered justice system, one for democrats and one for republicans.

    That the last I checked, the prosecutors of the States of NY and Georgia are not under the jurisdiction of the federal executive branch. Likewise, private litigants (like Carroll) are not in any way under the executive branch umbrella. Similarly, the litany of consumer fraud judgments against Trump-run companies had not an iota of politics weaved into the cases. Nor, for that matter, did the bankruptcies that followed his “leadership.” Similarly, the State of NY revoking Trump’s ability to have a charity because he was proven to have defrauded that charity, is nit under the executive branch.

    The “lawfare” and “weaponization of the executive branch” are great PR phrases. But they lack any basis in reality or fact.

    Hard for a jury to convict someone when no indictments or charges are brought. The Trump admin had plenty of time to bring charges. If she violated the law, bring charges and let a jury decide.

    It should be noted that Roe vs. Wade might be the greatest singular example of legislation by judicial fiat in the history of the judicial branch in this country. Roe vs. Wade getting overturned has allowed the abortion issue to become a relevant legislative issue, as it always should have been.

    What is ironic about the OP, is this lawyer laments and pines for the good ole days where judicial fiat puts the legislative branch in a straight jacket that hinders them from passing legislation to settle the abortion issue.

    The corrupt party is the party that wants a landmark issue like abortion to be settled by judicial fiat. The people who are stepping out of the way and being non-partisan are the people who rightfully acknowledge that legislation by judicial fiat is not how this issue should be settled.

    For this they are charged with "making decisions based on personal beliefs and political agendas."

    Trump has been pushing the myth of weaponization of the DOJ for the last two years. Ironically if he is elected it won't be a myth anymore but a reality. And yes we do have a 2-tier justice system. If any other criminal defendant had been defying gag orders as Trump routinely and blatantly does he would have been held in contempt with sanctions well beyond a token fine or would have had his bail revoked long ago like this guy.

    I don't think the casual viewer will realize how truly awesome this hodge-podge post of grievances, falsehoods and projection is.


    Biden "weaponized" the Executive Branch.....says a voter for the guy who (failed, but tried to) coerced an ally into holding a fake investigation of a political rival.

    Sadly, someone (HRC, who wasn't even brought to trial) wasn't convicted because....no jury would convict them?

    The fake IRS/Tea Party accusations, which doesn't really have anything to do with the judicial....

    "Two-tiered" justice, as we see a clearly criminal former POTUS protected by a collection of judges, in different venues, that he appointed himself.


    Very sweet boo-hoo post. Captures almost all of the right-wing falsehoods and grievance in a single post. Well done.

    All of the cases are being coordinated through the White House. There is proof of meeting and coordination. In NY, a high justice dept. official moved to handle the prosecution. Any non-political judge would have already thrown the case out.

    In Georgia, the same thing. Even the governor says the case is political and he and Trump can't stand each other.

    Easy for you to not want to see the lawfare as the side you support is doing it. No, the end does not justify the means when the result is a two-tiered justice system.

    Ah, yes, the non-impartial jury which is no better than the non-impartial judge. Typical of democrats to think this all in the name of maintaining power regardless of the cost to the republic.

    LOL! Weaponization by the democrats has been a fact of life since Obama weaponized the IRS. Unbelievable short sidedness by the democrats. You won't feel this way if the shoe is ever on the other foot.

    It should be noted that the IG report on the matter found both conservative and liberal key words were utilized to provide additional scrutiny, not just targeted at the right, and that the program began in 2004.

    Take abortion out of the equation - should judges be appointed who agree to put the appointor above the law? Should a judge be appointed who signals he will rule a certain way for a large donor of the appointor?

    When appointments are made based solely on political ideology, we have a broken checks and balance system.

    But I just cited a string of cases that had nothing to do with the White House - most predated Biden taking office. How is that Biden-driven?

    I’m pretty sure that if we had access to phone and email records we would find uh damn, what was that word you guys were all worked up about for 3 years?, oh yeah collusion between the prosecutors in NY and Georgia. Yes, that’s it collusion. Sorry I had a temporary brain fart. Carry on now.
