    Even without the “elder abuse” escalation from 2nd degree felony to 1st degree felony (which is crazy enough in a dispute between a 64 year and a 65 year old), dumping a glass of water on someone should not be a felony. What a preposterous charge.

    One thing you don't fight over in Florida is Keylime pie. Them's war words. I remember a trip to Key West almost 20 years ago when I almost started a war when I said, "So is Keylime pie better than New York cheesecake?"

    Pie is nothing to mess around with.

    When I was first married my wife and I went to Pebbles Restaurant in Longwood, FL had dinner and then ordered peanut butter pie. It was good. Real good.

    My wife, however, was full and we took her piece home. Two days later that pie was still in the fridge so “you know who” ate it. I’ll never forget hearing the refrigerator door open…silence…and then my wife say “Who ate my pie?” (We lived alone). Uh, that would be me - the doofus husband. She was upset; so, I went downstairs and called Pebbles to order a piece of pie to go.

    “We don’t do takeout” was the reply from the person who answered the phone. I told them the story and finished with “If I have to come there, sit down, order a piece of pie and then decide not to eat it there I’ll do that; but, either way I’m coming home with a piece of peanut butter pie.” Hold on - okay, you can come in.

    So, I arrive and start to explain why I’m there and the guy shouts across the restaurant “Hey, the guy who ate his wife’s pie is here.” :eek: So it goes. ;)

    There is a little known codicil in most marriage contracts that explains the ownership expiration date on pie in the fridge. My wife used to think "her" brownies ought to be safe for a week.

    This is what happens when lawmakers decide to be do gooders and put in mandatory sentencing without context of all potential situations.

    I am dealing with a much less serious yet non trivial matter in TX - charged with “Family assault with bodily injury”. This happened when I tried to prevent my bipolar and recovering meth addict adult daughter from driving off in a hysterical state in the middle of the night a while back. Someone called the cops and cops decided to haul me off, in spite of being told what was actually happening and nobody advocating for this outcome. Texas laws for family violence are stricter because of prior history in TX of battered spouses.


    I’m hopeful for a positive resolution but at a minimum will have encountered significant aggravation and non trivial legal expenses.

    Needless to say my faith in cops to do the right thing is somewhat diminished, and at a small level I can understand the level of distrust some have towards them.

    The arresting officer made a mistake. Dumping water on someone's head who is younger than 65 is a simple battery, a first degree misdemeanor ( 1 year county jail max.) The age of the victim here would enhance the misdemeanor to a third degree felony (5 years prison max.) To get to aggravated battery on an elderly person, you would have to have a victim at least 65 years of age AND the suspect would have had to either use a deadly weapon or intentionally caused great bodily harm. Both of those later two factors are absent here, the LEO overcharged it. It should have been charged as battery on a victim 65 years of age or older.

    Prediction: The victim will sign a request to discontinue prosecution and the State Attorney will either no file it or file it as a misdemeanor.

    If you have special needs kids, you will run into it. In addition to my daughter. Right now I have an 18 year old autistic son screaming and threatening me as we speak because he doesn’t like house rules. I can’t touch him because then I get in trouble. I call the cops either he gets taken away or I get taken away under family violence laws.
