    NO! Freedom of speech relates to governmental entities, assets and control. The free speech amendment does not affect speech rights when related to private entities, which Facebook is. It is NOT a free speech issue!

    I’m sure there are lawyers here who can speak to it better than I can. But if there is an issue, maybe it’d be whether or not Facebook has a monopoly or such a dominant position that it has certain public-access requirements.

    Don't think so. The issue is whether private property can become a limited public forum. I think twitter might be closer but I don't think either one are especially close. That said, we should not look at the laws and objective standard. This is a hot button issue for the right, and certainly I would expect to see Justice Thomas, at a minimum, mention it in some upcoming related opinion. The commentators on Strict Scrutiny were predicting that even before the thing came out. He has made some bizarre statements and concurring opinions which sound like he is directly out of the far far right wing world, as if we didn't already know

    Facebook doesn't even come close to meeting the requirements of classification as a monopoly in any reasonable market definition. There are multiple competing social media platforms that have thrived despite being formed after Facebook (Twitter, Snapchat, TikTok, LinkedIn, Reddit, etc.). And that is only if you define their market narrowly. If you view all other discussion online as their market, it get even more ridiculous.

    Declaring them a monopoly is just an authoritarian attempt to regulate them for curation activities.

    I read this somewhere else, but it's pretty funny that we've gone from Trump creating his own tv network to creating his own social platform to it actually just being a WordPress site that an intern could put together in like an hour.

    Indeed the courts have so far rejected any argument that these tech giants are monopolies. However, it is becoming a common way a common way a viewing them among the right.

    I have a doctor friend who is rather conservative, and he argued to me for a long time that government needs to take over Facebook to fairly regulate their content. I did not agree and he ended with the claim that “sooner or later Trump is going to get ahold of one of these companies, and you won’t like what happens.” It was surprising to me, as that was my exact argument against having the government take control, where the other party taking control was virtually guaranteed.

    In my mind, the comments by Trump.amount to crying fire in a crowded theater when there isn't one. There are few things more incendiary than a defeated president bellyaching that the election was fraudulent and encouraging his mindless and rabid supporters to commit acts of sedition. To be sure, the First Amendment doesn't apply, but FB certainly has the right - even the obligation - to prohibit incendiary posts and ban those who chronically post them.
