The Opinion states that "[a]t oral argument, Bertram conceded that the evidence of his conduct sufficiently proved the offenses of criminal trespass and misdemeanor theft." The Court noted that criminal trespass is a lesser included offense of burglary - but theft is not a lesser included offense of burglary. But the issue of a misdemeanor theft charge still wasn't clear to me. I'm speculating but perhaps, for example, the prosecutors didn't charge the misdemeanor theft because they didn't want to give the jury that option?
The article doesn’t say anything about the owner using a blower as part of his business, and I’m a little baffled that the homeowner didn’t make any effort to stop the man outside of yelling and taking pictures. Had it been my garage I would be pounding the guy with anything I could find.
It was probably something like an EGO backpack blower or a nice gas powered unit. My Stihl Kombi unit with attachments was $800 seven years ago. I just replaced the gas power head with the commercial battery power head which was $400.
