    Giuliani: Mueller's team told Trump's lawyers they can't indict a president - CNNPolitics

    The decision is based on long standing DOJ policy dating back to the Nixon Administration. Although it has never been tried in court.

    Doesn't matter as long as Mueller uncovers the truth. Let congress and the American people decide what to do with Trump.

    He's likely right. That's why Article I of the Constitution gives us the procedures for impeaching the President.

    He can't be indicted as well because they have yet to contrive the process crime with which to want to indict him.

    They had that literally before Mueller was appointed.

    That being said, Giuliani is a PR nightmare.

    Who in the hell thought it was a good idea to go out and talk about how "they have concluded they just get to write a memo, the DOJ rules don't let them indict a sitting president"? Because it's not a huge leap to read the subtext there as "they would indict him if he was anyone other than the sitting president," which I strongly suspect is not what Giuliani wanted to say.

    Reading further down into the story, I'm not sure if I was on the President's legal team that I would go with the argument presented later that, if you can't indict him, there's no purpose to interviewing him in the investigation. Because I suspect that the answer they'll get is that they can indict him, they just have to wait until he's not the sitting President anymore to do so if they want to, and it makes sense to conduct that portion of the investigation now concurrently with the rest rather than wait 2 or more years when facts are stale and recollections have faded.

    Go back and read my posts, I have never claimed that Trump was guilty of anything, though if Mueller did find something it wouldn’t surprise me.

    The point I was making wasn’t to race to indict Trump, it is that all of this is exactly what he was supposed to get us past. Instead half of his inner circle has been indicted and his fate is still in limbo. And all we get from the Trump team is attacking the fbi and declaring a witch hunt, and that he can’t be indicted because of precedent. And I am sure that any counter response to this post will follow that same framework.

    And when the next democratic president does one tenth of what this admin has done it will be the end of the world for the very same people defending him here.
