I appreciate your well thought out post, although I am going to disagree with you a little. I certainly am not going to hold myself out as knowing the regulations/laws governing the National Guard. What I do believe, however, is that ICE agents were breaking the law in L.A. as they have been doing all over the country. This is backed up by numerous courts around the country that have ruled that what ICE has been doing is illegal in numerous cases. Ice agents cannot just scoop up people without cause and take actions to incarcerated or deport them without affording them their due process rights. My guess is that the great majority of the aliens being detained by ICE are legally in this country until a judicial determination is made that they need to leave. That doesn’t mean they’re entitled to stay here forever, but they are entitled to their due process rights. Presumably, when aliens need to appear in court or in some other form of immigration office on a regular basis, they are entitled to currently stay in this country. And yet, ICE has been scooping up people when they have showed up for their immigration appointments. As for the example of the sixth grader that I posted, that, at least according to Governor Newsom, was an actual event that occurred a few days ago. Finally, the facts in LA that I am aware of seem to indicate that the LA police, and possibly the police of adjacent counties, could have addressed the limited violence and rioting that was going on without calling in the National Guard. So, for all practical purposes, The calling up of the National Guard and the Marines appears to have been another illegal activity entered into by the federal government.
