Alien Enemies Act doesn't apply. We aren't under attack and immigrants aren't soldiers invading under a foreign flag.

As for due process, it doesn't necessarily mean a trial by jury. It means fair treatment through the Judicial system. For undocumented immigrants, it means, at minimum a hearing if they request asylum or entered when they were a minor. Many of the migrants sent to CECOT weren't even given their hearing, and despite many never facing criminal charges, let alone being convicted of a crime, they were sent to rot in a prison.
