    surprise, another judge saying the potus is breaking the law..so many broken laws, so many injunctions, no wonder he ahd to blackmail so many legal firms into contributing hours after all the credible attorneys left the doj while their reputations were still intact

    ‘The act cannot sustain the proclamation’: Judge notes ‘fundamental’ problem with Trump’s use of wartime law, becomes latest court after SCOTUS to block deportations

    A federal judge on Tuesday afternoon made Colorado the latest jurisdiction to issue a ruling in the ever-expanding federal fight over due process under the law by barring the Trump administration from summarily deporting immigrants under the auspices of the Alien Enemies Act (AEA).

    In doing so, the court looked askance at the invocation of the AEA on a fundamental level and found President Donald Trump’s March 15 proclamation wholly lacking — divorced from both facts and law.

    Citing the original authors of several now-prominent and authoritative dictionaries, texts explaining how language was understood by the Founders, and decades of case law, U.S. District Judge Charlotte N. Sweeney, a Joe Biden appointee, determined that the U.S. is simply not in an actual war with Venezuela or a transnational gang from within its borders.

    And an actual war with a “foreign nation or government” — or an “invasion or predatory incursion” carried out by such a foreign entity — is expressly necessary for invoking the AEA, the court notes.

    Here's a CNN article with a summary of the decision if you don't wan to read the entire PDF. The Judge basically said Trump can't unilaterally come up with the conditions that would have him invoke the AEA and claim those conditions are met.

    “Allowing the President to unilaterally define the conditions when he may invoke the AEA, and then summarily declare that those conditions exist, would remove all limitations to the Executive Branch’s authority under the AEA, and would strip the courts of their traditional role of interpreting Congressional statutes to determine whether a government official has exceeded the statute’s scope. The law does not support such a position.”

    guess what, we aren't at war, the AEA isn't applicable, and the fentanyl doesn't justify the powers assumed as there is no invasion

    words like invasion and war have meaning and fake news can't just assign whatever meaning they want to them, at least not in a court of law. sadly it seems they can in our hor and senate right now

    A federal judge in Texas ruled that President Donald Trump improperly invoked a 227-year-old wartime law to deport accused Venezuelan gang members to an El Salvador prison, setting up what may become yet another high-stakes battle at the US Supreme Court.

    The decision Thursday marks the biggest setback yet for Trump’s effort to unilaterally deport suspected gang members under the rarely used Alien Enemies Act of 1798, which he invoked in a March 15 presidential proclamation that triggered a wave of arrests and litigation.

    US District Judge Fernando Rodriguez Jr., a Trump appointee, ruled the president’s actions weren’t legal because the US isn’t being invaded by a foreign force or experiencing a “predatory incursion” as required by the law, which would allow for removal of such aliens without due process.

    “The historical record renders clear that the president’s invocation of the AEA through the proclamation exceeds the scope of the statute and is contrary to the plain, ordinary meaning of the statute’s terms,” Rodriguez said in the ruling.

    I understand that this is the law and all, but what if we don't want to follow it because these people don't look like most of us? Or someone photoshopped tattoos onto pictures of some of them? Shouldn't the President be allowed to ship them off to foreign prisons in those cases?

    How Trump enforces the Alien Enemies Act is up to him. As I've said before, Trump has carte blanche. His decisions are not reviewable by any court.

    Trump should ignore all court orders that pertain to illegals.

    Pretty sure that I read taht the decision was specifically written to only include people being taken from the district that this court serves, ie only a small portion of Texas.

    The Supreme Court has previously ruled that the president can enforce the Alien Enemies Act and his decisions are not reviewable by any court.

    Many decades ago Moscow told American communists to call people fascists if they disagreed with their ideas. Are you a communist? Would you like to see America become a communist country? Have you ever criticized Stalin or Mao?

    Whether someone gets "due process" depends on whether they have a property interest or a liberty interest. Illegal immigrants don't have either, so they are not entitled to due process. They get an executive hearing and that's it. They are not entitled to a lawyer. Megyn Kelly mostly gets it:

That's why you and your Too Hot lib pals supported the importation of 20M illegals into the US. You want them situated in swing states and you want them voting for your team.     I think this could be fun: I'll criticize 4 different commies in 1 sentence (admittedly, it will be a long one) and all you have to do is criticize one of them: Vladimir Putin. Here is my criticism:

    Kim Jong Un is a fat little sociopath that regularly kills innocent people when not meeting with his only three friends on the world stage- Xi Jinping (the genocidal head of the Chinese Communist Party), Vladimir Putin (the KGB officer turned kleptocratic representative of Russian Organized Crime), and Donald Trump (the guy trying to install central economic planning and the ability to send people to gulags without due process in the US).

    Your turn. Let's hear a good solid criticism of Vladimir Putin, if the employer allows it.

    Long thread from Margot Cleveland that sums up the Federal District Court decision. Ultimately Trump can ignore the courts (as did president Andrew Jackson). The courts will be powerless to do anything to stop Trump. If the lawless Democrats retake the House they'll be impeaching Trump for any little thing anyway...
