    That is a nice aspirational goal for collectives to not know a coach would not want a player at a certain price, but it is totally unenforceable and likely not provable in any context: court or NCAA. I highly doubt CBN ever gave a player a number directly.

    I’m not talking about giving out numbers. I’m talking about possibly killing a deal you had no legal right to be in the middle of. Proving any of it is always going to be tough. There’s reported text chains that elude to him being more involved in the process than he was allowed to be, as were pretty much every coach in the country. They’re not all being sued though.

    I'm not an attorney, but this lawsuit is crap. Gator Collective not named. The whole thing is based on fraud, which will be hard to prove.

    In my opinion, Rashada's side is banking on the following: Billy Napier HAS to win in 2024 or be fired, therefore he has no time to fight this. Any off-field distractions are likely to have severe negative impacts on Billy's 2024 record, therefore the smart (no pun intended) thing to do is settle. Rashada's camp doesn't want to get to the point of discovery, depositions, trial, etc. So they are crossing their fingers that Hathcock steps in and settles it for everyone.

    Which makes this even more of a "frivolous" lawsuit. The Rashadas either get money or get Billy fired via off-field distractions that hindered his 2024 record and get a last laugh. Hathcock can fight this if he wants, Castro-Walker is just a name in there to add details. The Rashada's main target is Billy.

    Unless of course Billy and Hugh's side fight this.

    My own opinion? Fight like hell. Rashada will fold like a lawn chair in a deposition. This is wrong and if we allow Rashada to settle and get money it will open the floodgates for it to be repeated in the future. We are years away from the NCAA somehow getting a handle on these situations. I realize that I can't advocate for this, and then criticize Billy if he goes 4-8. Guess I can live with that.

    I think you are wrong. Rashada's attorney wants discovery.
    If anyone did even one thing not in line with Florida's NIL law, it's a slam dunk for them.

    I would bet the previous collective wasn't completely above board.

    Billy has been on record from the beginning that we won’t get into bidding wars for players. So yes it seems plausible that he could have shut down the whole deal with this puke kid as soon as he caught word of it. And I applaud that

    Fair point, but the dirty laundry will also be aired out on Rashada's side. He may be considered damaged goods after this and his football career could be over. He may come out with money, but no future in football. What is he then gonna do, sue because he sued and won?

    Good attorneys hired by Hathcock would eat Rashada alive in a deposition.

    So I'm guessing Rashada's side wants a settlement and not a fight where proving fraud is difficult. They aren't suing for breach of contract or not following Florida NIL laws. The only ones bound by NIL laws here would be the Gator Collective, and they are not named in the lawsuit.

    If we told them to pound sand and there was discovery, what would be the problem other than showing the dirty, seemly underbelly of college recruiting. The NCAA is pretty much toothless to do anything. So it would all get exposed and Rashitta would get nothing.[​IMG]

    Would anyone be surprised if Kirby was involved some how with Hardin? Muddy up CBNs name and get his player some coin.Smart is enough of a douchebag to do this

    I'm still not following you. CBN can't kill a deal that a collective or booster is paying for. There is just no possibility that Rashada can prove intent to not get him paid out of ill will or hurt a rival or some other theory for the lawsuit side of this and from the NCAA side they don't even care anymore about the schools' or coach's involvement. All this can be is embarrassing.

    Whatever rule or law that prohibited Napier from engaging in the NIL negotiations does not keep Billy from refusing to allow Rashada to join his team. No collective or NIL deal can force a coach to take a player.

    Billy sent Jaden an LOI and accepted it when it was signed and returned. He didn’t refuse to let Jaden join the team. Jaden refused to join the team and requested a release from his LOI after his NIL deal was allegedly rescinded.

    There’s some quotes in several articles with Billy reassuring Jaden that he’ll get his money, Hugh is in the air and he’ll take care of it when he lands, etc. If any of this is true, Billy was way more involved than he should have been.

    I have little doubt that a coach catching wind of a deal he thinks is bad for his team could potentially blow that deal up. The people in control of the money side of the deal want him to be happy. I think they would listen whether they were supposed to or not. Kryponite just said “But that third party doesn't want to make the deal unless the coach believes it is good”, implying he believed the money is talking to the coach about the deal. The fact is, they weren’t allowed to do that when this was happening. The coach was not supposed to be playing a role in these deals. At the time this deal was being done, the coach wasn’t even allowed to put the money and the athlete together. If you believe the money was talking to the coach to make sure a deal was good, I’m not sure why you find it hard to believe a coach could potentially blow up the deal.

    ***Actually I do see in your other post that you, skink, believe the coach COULD blow the deal up. I’m saying the same thing. The problem is, I don’t believe he was legally allowed to. Kryptonite believes the coach was consulted but couldn’t blow up the deal. That, I have a hard time wrapping my head around.

    Totally agree! There's no merit to this travesty, and it's all about a payday. More than likely this will be settled, because this is not just about Billy--it involves the University of Florida the football team, fans, and the media. From the outside, the media considers Billy guilty and Jaden the victim of deceit. More than likely this will be settled, because the longer it drags on, it serves as a huge distraction!!! It benefits no one to let this drag on!
