Props to DeSantis/Senate for tort reform in regards to Florida insurance

    We have State Farm and it’s 15 for a shingle roof here.

    They do want you to have five MORE years on your roof, not five years old, at least here.

    We’re curious about tile roofs as ours will be 10 years old this summer.

    I called our agent and he said next year since my roof would be 16 years old they would require a roof inspection at my cost or a replacement.
    I'm curious about your tile roof also.
    I wonder what they'll do with those who have asbestos tile roofs

    So with tile much like all roofs 15 years but with an inspection you can get 5 more

    Citizens requires 3 years remaining life on your roof based on your latest 4point inspection.

    So if I write your policy today with a 4pt that was written this year showing you have 4 years remaining life on your roof, next year you will get a notice that they will non-renew you because you will have less than 3years remaining life.

    Come on now you know that frivolous lawsuits are settled everyday because the cost of litigation is so enormous.

    There's not much incentive to pursuing unworthy suits. Keep in mind that by cleaving the statute of limitations and not delaying the implementation of the statute, the legislature forced them to file prematurely to protect their clients' rights. That strips them of time to conduct more thorough pre-suit investigations, thereby making frivolous lawsuits more likely.

    I thought tile roofs in general were considered 30 year roofs. I believe they are cheaper to insure than shingle by quite a bit but metal is the best from an insurance standpoint

    I don’t think that’s totally accurate. Many PI attorneys know they can threaten a suit and get paid off. Last I heard it was 100k to defend a 1 week trial for defense attorneys.(ballpark number).

    Crappy personal injury attorneys may well try to do that looking for a quick payday. But it's not worth the time of good personal injury attorneys. They develop cases that have the potential to lead to large verdicts or settlements. They're not chasing nuisance settlements.

    The risk of chasing nuisance settlements is if the other side calls your bluff, you're out your own money and time. Skilled personal injury attorneys don't invest their time and resources into cases that don't have the potential for a good payoff.

    I don't have the highest opinion of Morgan & Morgan, but they're not the sort of folks who are chasing a bunch of nuisance settlements. They're looking for legit paydays.

    Fair enough but I would think the dime a dozen PI guys out number the “big boys” 50-1. My employer actually had to deal with a M and M guy about 5 years ago regarding a former employee.
    They would have lost going to trial but his defense atty convinced him to pay 15k to make it go away rather than go to trial. They took the money and ran.

    Tile lasts a lot longer and holds up much better to heavy hurricane winds. It’s also obviously heavier, so I think not every home can handle tile if the roof structure wasn’t designed for it. It would be ridiculous to replace a tile roof every 10 years. I think tile needs to be considered 25-30 years minimum, especially considering how expensive they are (several multiples of shingle for each replacement).

    On the heals of this landmark legislation purportedly designed to reduce insurance costs, Citizens proposes a 14% statewide price hike.

    Look to the windshield replacement litigation. The bottom feeders who "specialize" in auto glass cases are leading the pack on this insane litigation.

    To get prevailing-party attorneys' fees, you have to win. If you win, your claim is by definition meritorious, not frivolous.

    Yet comp rates are still the cheapest part of your car insurance by far.

    When I worked at Nationwide part time while a student in Gainesville my supervising adjuster said that it's a business decision to settle and that it rarely mattered if the claim was legit or not because the threat of legal costs were not worth the risk. I forget how many years someone had to file a claim but they'd rather pay out a "nominal" amount than fight it. She also said there was a vast difference in settlement amounts depending on region. Someone in Miami would scoff at an amount proposed to someone in South Carolina.
