    So how many subpoenas do you think they should do before utilizing a search warrant? 2? 4? 11? How many should he be able to not fully comply with before engaging in a search warrant?

    Heritage had somebody say that a President can declassify something without even telling anybody or doing anything other than thinking about it a few days ago. So, perhaps all Biden has to do is think about it being classified and, boom, they are!

    Why now? It's been 18 months. IF something like "nuclear documents" were in fact in Trump's possession, then they should've recovered them over a year ago. If they kept having success getting documents, then keep doing what they did. It's that simple.

    What’s even easier is to hand them all over at once, even before being subpoenaed, or simply not take them without going through the statutory process in the first place.

    So now you are saying that they should have been more aggressive in recovering the documents (when they were trying less aggressive measures since May 2021) and that also they should continue the less aggressive measures indefinitely as long as he doesn't completely ignore them, even if he is only partially in compliance? Doesn't sound so simple...

    This is a very old statute and we had a lot of discussion about it in the HRC private server days. It is a WW1 era law concerning defense secrets, largely concerning information about weapons, ships etc. It would be applicable to nuclear secrets. What you highlighted is only a part of the language.

    He didn't show them. He left it up to the DOJ. It's not the same thing. He could have kept quiet about it this entire time but forfeited his legal right to privacy the moment he opened his mouth about the raid.
