    They would do the same for any non-violent offense no matter who committed it

    it was called non-violent because it was only attempted, not carried out, does the fact he would have carried it out if not stopped not bother you?

    I dunno, the article makes it sound more funny than horrifying. But are we going to base the legal system of what might have happened rather than what happened? No, that would be stupid. Does someone need to be in jail for taking a swing at someone and missing in a barfight too? No.

    Seriously, they make these key chain things that are like brass knuckles that have two points for the “ears.” The ones I’ve seen are plastic, but you could do some damage.

    It was an inexcusable attack and should be punished. And now for some partisan deflection:
    • No harm, no foul
    • Weapons don't hurt people; people with weapons hurt people.
    • We need to address mental illness, not kitty defensive tools.
    • Too bad there wasn't a good guy with a gun present; this was obviously due to flawed gun control policies.
    This is how it's done, yes?

    It’s important to note the differences between trying to assault someone, actually assaulting someone, and battery. Those charges are governed by the facts. After reviewing them, the state decided all that happened was an attempt. New York believed past abuses of the bail system - and everyone has the right to bail - did not warrant imposing bail at all for the minor crime charged. I think they’re right, and I had 40 years experience in the judicial system.

    What is it exactly that you wished NY could have done? I think you’re operating under the mistaken belief there will be no consequences for the defendant. He’s been charged. If he goes to trial and is found guilty, he’ll pay a price. However, he won’t get any significant jail time. Why impose an onerous bail and keep him in jail in the meantime. America doesn’t work that way, fortunately.
    ADDENDUM: After watching the video on ABC's "fake news" (have I got that right?), there seemed to be more than just an attempt. He appeared to lay his hands on the speaker, which is a battery, and drew back to stab him before being pulled to the ground, the speaker with him. I've no idea why the state did not allege battery in its charging document. It was an ugly confrontation.

    It does, but whether something bothers you or me is irrelevant when it comes to proving the elements of a crime as defined by the NY statutes. Are you advocating an extra-judicial punishment for him outside of what the law allows?

    This same logic is going French applied to guns. Some want to base legislation on what might or could happen.

    This attack is a non starter. The bigger issue is DAs in certain cities letting truly disposable criminals and violent repeat offenders back o the streets to continue committing crimes
