Garcia vs Noem Lawsuit

    > 120. Upon arrival at CECOT, the detainees were greeted by a prison official who stated,
    “Welcome to CECOT. Whoever enters here doesn’t leave.” Plaintiff Abrego Garcia was then
    forced to strip, issued prison clothing, and subjected to physical abuse including being kicked in
    the legs with boots and struck on his head and arms to make him change clothes faster. His head
    was shaved with a zero razor, and he was frog-marched to cell 15, being struck with wooden batons
    along the way. By the following day, Plaintiff Abrego Garcia had visible bruises and lumps all
    over his body.


    >121. In Cell 15, Plaintiff Abrego Garcia and 20 other Salvadorans were forced to kneel
    from approximately 9:00 PM to 6:00 AM, with guards striking anyone who fell from exhaustion.
    During this time, Plaintiff Abrego Garcia was denied bathroom access and soiled himself. The
    detainees were confined to metal bunks with no mattresses in an overcrowded cell with no
    windows, bright lights that remained on 24 hours a day, and minimal access to sanitation.


    >122. After approximately one week at CECOT, prison director Osiris Luna and other
    officials separated the 21 Salvadorans who had arrived together. Twelve individuals with visible
    gang-related tattoos were moved to another cell, while Plaintiff Abrego Garcia remained with eight
    others who, like him, upon information and belief had no gang affiliations or tattoos.


    >123. As reflected by his segregation, the Salvadoran authorities recognized that Plaintiff
    Abrego Garcia was not affiliated with any gang and, at around this time, prison officials explicitly
    acknowledged that Plaintiff Abrego Garcia’s tattoos were not gang-related, telling him “your tattoos are fine.”


    >124. While at CECOT, prison officials repeatedly told Plaintiff Abrego Garcia that they
    would transfer him to the cells containing gang members who, they assured him, would “tear” him
    apart.


    >125. Indeed, Plaintiff Abrego Garcia repeatedly observed prisoners in nearby cells who
    he understood to be gang members violently harm each other with no intervention from guards or
    personnel. Screams from nearby cells would similarly ring out throughout the night without any
    response from prison guards on personnel.

    I know it will never happen, but anyone who knowingly sent a non-criminal to CECOT should be facing jail time.

    MAGAs will read about these abuses and scroll past ..... pretending it didn't happen.

    Also, it's acceptable to send non-citizens to foreign prisons and beat them. Even if they were legally allowed in our country. Donald Trump said so.

    I just keep thinking of Andry Hernandez Romero. He is a gay makeup artist who claimed asylum a year ago and was going through the process. He was crying and praying as he was being led into Cecot. It was witnessed by a reporter for 60 minutes and reported. I hope that they did separate him from the gang members, there is no way he is still alive if they didn't.

    We aren't supposed to talk about the millions of dollars spent on a gulag for people who mostly have been convicted of nothing, including immigration crimes. It makes certain people feel bad.

    Why limit it to non-criminals? This constitutes as cruel and unusual punishment even for those that are serving time, not to mention those that have already served their time, haven’t been convicted, etc.

    I don’t have a single issue with those that come here legally. He did not do that. In addition to illegally entering the country he is currently accused of some pretty despicable things. Will you admit your foolishness if he is found guilty.

    Hey, what happens in El Salvador stays in El Salvador?

    Garcia is not a martyr as some believe. He is a bad person (anyone who beats his wife is a piece of crap in my eyes) and does not need to be in this country.

    Maybe he is here legally; maybe he isn’t, but this isn’t the point. The point is that he was allegedly beaten with baton until bruised and held without access to a bathroom until he soiled himself. Do you think it is ok for the government to treat someone that way?

    Right here
    He might be made into a martyr if the government keeps treating him this way, but the real point has always been the same: people are not allowed to be jailed indefinitely because of the opinions of random message board posters. I don’t know that he is innocent anymore that you know he is guilty. That’s why we have the courts, so why don’t we just hold our judgements until the courts rule?
