Not sure if this is the right thread for this but since transfer portal /other schools thread closed… Wisconsin files suit against Miami for poaching Xavier Lucas while he was under contract with school
I started a new thread with your post so we can keep track of this potentially groundbreaking lawsuit. Anything that helps curb the outright poaching of players is a good thing, IMO. Edit: If you're uncomfortable with the title I gave it, go ahead and change it.
I was hoping Wisconsin would have the balls to file this. Of all the crazy shenanigans, there remains the base principle that one cannot intentionally interfere with another’s contract, unless there is a legal justification. If Wisconsin establishes that its player was under contract, and Miami induced the termination of that contract, with no lawful justification, I think we will see far less movement.
One thought is the contract is not with the school, so Wisconsin may not have standing. That from an attorney on the board .
I suppose that Wisconsin could be a 3rd party beneficiary harmed by interference with a contract, so that might not be a silver bullet. I expect these universities with law schools have competent counsel writing contracts for these collectives.
