    Ah, yeah, there are some distinctions between the two situations, but in neither case did the President need someone’s permission to act. He already has the statutory authority to direct the National Guard in either case. What we are really talking about is norms, not rules. In the first case, you really want the Speaker to request National Guard presence around the Capitol so it doesn’t appear to be imposed on her. In the second case, you really want the Governor to decide whether or not a National Guard presence is necessary to protect federal law enforcement in their duties. But we’re also talking about a world where political figures who have to coordinate these things don’t legitimately hate one another and would make a decision ultimately against their own or even the public’s interest just to spite the other person.

    Just my professional opinion here: what I’m seeing happen in LA right this moment, I think the Governor would have had to call up the Guard by now (he can never, not ever, admit that at this point, of course), but he would have been 12 hours behind the President. My hope remains, same as most of you, that 79th IBCT’s deployment deters any further spread so that there’s no more talk of putting Marines into LA like 1992. The Marines will do a top-notch job at restoring order and protecting property, but they are not locals so they will not have the same interest in de-escalation (in those situations where de-escalation is possible). I also have selfish reasons. My brigade is on annual training right now (so far unaffected by federal activation; knocking on wood). I’m supposed to start full-time civilian work back in Tampa a week from Monday. If this turns into full-on Dawn of the Dead, then I don’t like my chances of making it to my first day. :(

    That’s undoubtedly true, but that doesn’t change the optics and politics of the situation. I totally agree that Trump should not have sent the troops without permission from Newsom.

    I’m just saying that when the president and governor are on opposite political sides often the governor in question hesitates to act for political reasons, and then when things go south they blame the president for not acting.

    GWB got excoriated for Katrina and there was a lot to blame that admin for, but ultimately the Demcratic governor did not want help.

    After Andrew there was a delay in deploying national guard. Lawton Chiles was governor and didn’t immediately request help. But GHWB was blamed.

    I mentioned Oregon with George Floyd protests. They did not want Trump to intervene. It became a mess. It is their right to handle it as they see fit but the track record hasn’t been great.

    I think the wording of what you mean is off a little. Let’s tackle that first then examine what you do mean. “Permission” is not the right word since the National Guard is really only under the authority of state governors at the pleasure of the President, who can assume authority at any time for any reason. I think what you mean is that the President should not have taken authority away from the Governor so quickly, and that might very be, and we may never learn the key details. For instance, was there a private conversation where the President and/or Attorney General described to the Governor the violent interference federal law enforcement was facing in LA, and they requested state assistance? Did the Governor agree or did he stand on the principle of not cooperating with federal immigration authorities? We certainly know the Governor refused to call up Guard units under state funds. He said so. Did the President make the offer to use federal funds if the Governor would only make the request? Did the Governor then refuse? Did the President warn him, look, one way or another, ICE is going to get those Soldiers watching their backs. Do you want to do it, or do I have to? I can’t answer any of those questions yet, but I’ll bet some of that will leak out in the days to follow. Knowing what we know about those two personalities, it’s possible that Trump never gave Newsom any agency, input, or wiggle room in this whole thing and just acted to embarrass him. But it’s also possible Trump gave him every possible off-ramp, and Newsom wanted his George Wallace moment, heroically defying the President. It’s going to come out, though.
