    Well considering that’s 200 or 400 years, not sure anybody’s worried about that.

    200 years ago the country (a country of barely 10 million people!) was debating unfathomably stupid stuff like “The tariff of abominations” and whether states could nullify federal law… oh… wait.

    History tells us that if we keep going down the path where Constitutional protections and due process have no meaning, then neither will elections.

    I've said it before, I'll say it again. America needs a national divorce. The two sides are far too polarized now. Accept that we'll never agree on almost anything.

    Let American split up into multiple countries. There can be a West Coast country, a Northeast country, a Midwest country, a Southeast country and a Big Sky country. Hawaii, Puerto Rico and Guam can all go back to being their own countries. Alaska could easily just join Canada, which is probably where it needs to be anyway.

    Let each American country set up it's own government and laws and then have a 5 year grace period where citizens are able to move from one country to another, no questions asked. If you don't move, then don't cry about the decisions of that government. So if you're a conservative in California and refuse to move, don't cry about the decisions of an ultra-left wing communist government for the West Coast country. If you're a liberal in South Carolina and refuse to move, don't complain about a government with a state sponsored religion where personal life is very regulated (no abortions, no hard drugs, etc.) and the traditional nuclear family is pushed that you would see in a ultra-right wing conservative government for the Southeast country.

    Maybe let South Florida and the Keys break away from the rest of Florida and the rest of Florida would join the Southeast country. People have choice, both sides finally can join countries where their government truly represents their values and will.

    If not, the only other option will end up being a Civll War.

    Ignoring its impracticality, this proposal offers no solution to problem you highlight. As Madison noted in Federalist 10, “As long as the reason of man continues fallible, and he is at liberty to exercise it, different opinions will be formed.”

    There simply won’t be consensus in any land that is free. Even if everyone starts out this way, quickly their judgements of their new state will diverge. Not to mention the diversity of thought in the following generations, who made no such choice of residence.

    Either way, you are going to need a constitution and culture that reigns in tyranny, and we are already living in perhaps the most successful such state in history.

    Its my position (I wont speak for TH) that that number is one you've pulled completely out of your ass, mostly because conservatives love juicing the numbers by saying "encounters" = unique undocumented individuals living in the USA. So good news, you dont have to have 30 million trials because that number exists only in your imagination!

    Making up numbers is fun. And yes, if you want to make immigration violations a criminal matter (which is what the Republican Party of the last two decades did), then it should require some form of court case, as that is what we do with questions of criminality. I suspect this is why the Republican Party has taken illegal entry from a civil matter to a criminal matter to, now, a military matter.

    Due process. It's in the Constitution. Suspend due process for one group, it becomes a slippery slope to be able to suspend it for others. And then the Constitution becomes meaningless.

    This clip doesn't support what the tweet claims. He was explaining circumstances where due process wouldn't apply, like someone who has been in the country less than two years, didn't claim asylum, and with false papers (which in all honesty I didn't know). Also that the Trump admin is trying to stretch the Alien Enemies Act to extend their authority to bypass due process but they keep losing that battle in court. He did not claim that Trump admin has the right to do what they did with Garcia, although if they weren't so incredibly stubborn about the situation they have other options to deport him legally.

    Undocumented immigrants 18 and older aren't do due process if they are caught at the border or within 2 years of entering and, and this is a big and, they do not request asylum. These immigrants can be summarily discharged. Undocumented immigrants who must receive a hearing with an Immigration Judge are all those seeking asylum, those in the country for more than 2 years, and those who entered as unaccompanied minors.

    Abrego Garcia qualifies under two of these requirements. He's been here for more then 2 years, and entered when he was 16 unaccompanied. AG did receive his due process with his 2019 hearing, in which he received an order of protection to stay in this country. As the lawyer in the interview states, the Trump admin can reopen the case and having another hearing and present the new evidence against AG in an effort to deport him.

    But that's not what happened. AG was abducted by ICE, and without any hearing (no due process), AG was shipped off to prison despite having no criminal record. No, AG isn't due a full jury trial a la OJ Simpson, but he is due another immigration hearing in front of an Immigration Judge, per the Supreme Court ruling.

    So are millions of other undocumented immigrants. Including the Venezuelans now in CECOT, assuming they either requested asylum, entered as unaccompanied minors, or have lived in the US a minimum of two years. They are not enemies combatants, and multiple courts have ruled the Alien Enemies Act does not apply.

    Trump is playing more deportation shenanigans (and crimes against humanity). He is sending illegal immigrants from Vietnam and Myanmar to South Sudan, a country known for civil war and violence. Oddly enough, illegal immigrants from South Sudan cannot be deported to their home country because it is too dangerous.
