    And you're still in a state of denial comparing the former president's intentional obstruction, deception and refusal to return classified documents with the willingness to cooperate of Biden and implicitly Pence regarding their admittedly improper handling of classified documents. Once again borrowing from Sesame Street and paraphrasing a former intelligence officer comparing Trump with Biden and Pence, one them is different from the others.

    I don't believe I said they are the same thing!!! I think all I have said is both situations are not good. I said Trump and his team were definitely in negotiations about the docs. I said Trump assumed they were unclassified, as he had that right. Because the, not jump to conclusion, side has said there are similarities but there are differences. You guys are the ones acting like Joe is completely lily white and Trump is the devil. I have consistently said, let's see what both had before passing judgment. I will not blindly believe the accounts of anonymous actors that leaked to the media partial truths. But go on about your day and feel the way you do if that's what it takes to supporting what we currently have.

    I guess you cannot help but to defend Trump. The chances are that in Trump's case the classified documents ended up at Mar-a-Lago because they were inadvertently packed with unclassified documents most likely by staff. The same applies to the documents that were discovered at the Penn Biden Center and at Biden's home as well as the documents that were discovered at Pence's home in Indiana. The difference is that both Biden and Pence cooperated with the DOJ and officials from other federal agencies like the national archives and in the case of Biden even inviting the DOJ and FBI into his residence to search for documents. In contrast Trump who referred to the search of Mar-a-Lago pursuant to a court issued search warrant as a "raid" and even claimed that the documents were planted.

    If Trump returned his presidential documents as requested by the National Archives this would have never been a story. He thought that he had a right to the documents (both classified and unclassified). After the National Archives requested the documents he refused to comply and even had them moved to different locations within Mar-a-Lago with the straw that broke the proverbial back of the camel being his lie to the court through his attorneys claiming that he returned all of the documents when he in fact intentionally failed to do so. His intentional failure to return the documents is a matter of record, it's not based on leaks from some anonymous actor or actors.

    Where does this lie that Trump was in negotiations come from? He had 14 months since his first notice from NARA that the documents were missing to return the docs NARA was requesting. Not 14 days or 14 weeks, but 14 months! And in that 14 months he did agree to return "all" the docs, but ended up only returning roughly half, and then lied on an affidavit claiming all the docs were returned, when in reality, they were not. How is this negotiating? It certainly isn't negotiating in good faith.

    Yes, both Biden and Pence had a longer period of time to return the docs, but the major difference is NARA did not know the docs were missing, and didn't request for them to be returned. Judging by the actions both Biden and Pence took once docs were found, it's a reasonable assumption that had NARA notified either Biden or Pence, their docs would have been returned within weeks, if not days. Not months.

    What Joe did is bad, but it's also not that uncommon, and shown by the fact that Pence did the exact same thing. A small number of the exorbitant of classified docs that pass by a Vice President during his tenure were accidently packed in boxes that ended up at the wrong destination after the VP's time in office ended. The FBI has a name for these cases. Leakage, and they deal with them all the time. And in general, as long as the person cooperates, returns everything, and no harm was done, then the DOJ doesn't pursue charges.

    What Trump did is significantly different. He didn't just take a small number of docs, but hundreds. Even if we assume this happened because of leakage, and Trump mistakenly took the docs to MAR instead of NARA, you cannot say he cooperated. Again, 14 months, lying, misleading, moving the documents around to hide them, and refusal to return everything time and time again. Had this not been the case, the judge wouldn't have agreed to sign the warrant.

    Oh, and the classification of the documents in Trump's case is not in question. They are still classified. Why? Because while Trump did have the power to declassify, docs aren't considered declassified until the two-step verification process is complete, and the doc is officially marked declassified. Until this process is over, the docs are considered classified, because there is way of distinguishing a doc that will forever remain classified, and one that is in process of being declassified. And the Trump docs? No record the process of declassification ever started. Therefore, all docs must be considered classified.

    Whatever to both of you Biden loving defenders!!! I'm not defending Trump, I merely sating let's see what they had and as far as cooperating. Why didn't they let us know for 2 months? Why did they say there is no more docs, yet find them in 3,4 5 more places? Live in your anti Trump fantasy land all you want.

    Okay. Let's see what happens when the Special Counsel reports are issued. My guess is that Hur, the special counsel investigating Biden will find that although Biden probably as the result of the carelessness of his staff may have mishandled classified documents his negligence didn't rise a level in which prosecution would be appropriate. Jack Smith on the other hand will most likely find that Trump's behavior based on intent and a number of aggravating factors did rise to a level in which prosecution would be appropriate although even if that's the case Merrick Garland may still decide not to prosecute Trump strictly for political reasons and optics not because the Donald is innocent.

    Biden didn't announce the finding of the documents because of standard DOJ policy. That policy is no announcements that are potentially political in nature within 90 days of a major election. The docs were originally discovered during this window, and disclosed after the results of the election were over. This 90-day standard policy also played a part in the timing of the FBI retrieval of the Trump docs. The "raid" occurred 91 days prior to the election.

    As for Biden, there were no more docs found at his Penn office. New docs were found at his Wilmington residence, but only because Biden allowed the FBI complete access to his home to search. That's called cooperating. In contrast, the only way Trump gave up the docs he lied about having was through a warrant requested by the FBI, and signed off by a judge.

    This isn't defense of Biden calling him lily white, and anti-Trump. These are facts that are comparing and contrasting the two cases, along with the third, Pence case. And while you are entitled to your own opinion, you are not entitled to your own facts.

    Which is exactly what you are supposed to do in this situation. Get the docs out of the area(s) they don't belong, and get them where they belong, which is what NARA does best. The DOJ comes in after the docs are secured.

    The Biden docs didn't take long for NARA to secure, because again, Biden cooperated fully. The DOJ still waited to announce anything because again, the 90-day window during an election.

    Borrowing terminology that the right uses in reference to the FBI search of Mar-a-Lago, I guess we can say that Biden invited the FBI to conduct a raid of his Delaware vacation home.

    Except that it’s very likely that these were packed up by aides in the cases of Biden and Pence. You don’t think these guys pack up their own offices, do you?

    Again, leakages such as what happened with Biden and Pence happen. Even Carter found classified docs in 1981 at his home in GA after he left office. But as the article states, usually the docs are returned with little fanfare, and punishment is rarely, if ever doled out in these circumstances. Especially if there is no ill intent with the docs, full cooperation to return the docs, and the docs were misplaced on accident.

    With Trump, it's different. He didn't cooperate, which ultimately lead to the FBI requesting and being granted a search warrant to get the docs returned. Had Trump cooperated and all the docs requested in March, 2021 been returned by April, 2021, Trump's docs, Biden's docs, and Pence's docs are all likely non-stories.
