soldier killed/murdered by fellow GI's

    They'll be prosecuted under the UCMJ. Someone correct me if I'm wrong, but as I understand it, the UCMJ does not have any "hate crime" provisions. So, the whole thing may be moot.

    But, it seems pretty clear to me....

    If three white soldiers yelled "n*gger" at black soldier before knifing him to death, no one would question whether it was racially motivated. Al and Jesse would be on the first plane to Washington state to do their pimping.

    agree....

    is there the ability for family to file civil law suit separate from UCMJ?

    I doubt it. In general, the Feres Doctrine prevents service members or their families from suing the DoD for death or personal injuries incurred while on Active Duty.
