I'm not about to guess what a jury will do. I missed on both O.J. and Casey Anthony.
Her testifying is nothing more than the prosecution trying to get emotional mercy points against GZ, and if she has nothing valid to add to this case, she shouldn't be testifying anyway.
Not to mention she and her husband should have been gag-ordered shortly after GZ was charged and there was going to be a trial.
It really surprises how weak a case the prosecution has. I mean, I realize that politics and the LMSM and idiots like Al Sharpton and Jesse Jackson are the only real reason why this even went to trial, but you'd think they'd have something better than they've presented so far.
I honestly do not know how the judge can allow this trial to continue after the prosecution rests. It's already reaching circus levels in the fact that there is just nothing here for the prosecution to hang it's hat on.
I never guessed about Anthony. I predicted OJ would get off.
George Zimmerman's training (part of the requirement for his concealed carry license) would have drilled into his mind the requirement to never deploy his weapon except to prevent his or another's death or serious injury. I firmly believe that his weapon was holstered when the altercation started and was not deployed until he was on his back and believed that he was in danger of losing his life. Both GZ and TM made poor decisions that night but I don't believe for a minute that GZ was holding a gun when TM punched him in the nose.
Lawdog, curious on why a lesser charge was not an option in the Casey Anthony case? Was that because it was 1st degree pre mediated?
The state didn't separately charge the lesser includeds as separate counts, but if I'm remembering correctly the jury instructions and verdict form did provide for verdicts on lesser included charges to the first degree charge of: second degree murder, manslaughter, and third degree felony murder. The jury just acquitted on all of them.
Any info on trajectory of the shot?
Lessers were an option in the Casey Anthony case on virtually all seven counts.
On Count One, these were the choices:
I have to admit the prosecution's case is much weaker than I thought it would be. I expected it to be difficult for them to prove that Zimmerman was somehow not entitled to defend himself just because of the lack of evidence. I did not expect this much of prosecution's case to actually support Zimmerman's version of events. And it has. I'm not certain Zimmerman will have to put on a defense; the prosecution has done it for him so far. Anyone still in denial (Chomp, Avatar) over this should go over to MSNBC's website: You will find nothing on their front page, and no news organization has invested more in a Zimmerman conviction than MSNBC. If there was any remotely good news in terms of a conviction, then they would be reporting it.
You know Gr8t, it had been so long, I forgot the M.E.'s autopsy report had been released last year. I reviewed it and it more or less does not describe any trajectory and / or path of travel on the axis of the body, but basically describes the wound as frontal, straight into the chest (directly, front to back), 17 1/2 inches from the top of the head, one inch to the left of the anterior midline (center line of body), and on a line one-half inch below the left nipple.
The GSW was described as intermediate range (meaning anything greater than a contact wound), with soot, ring abrasion, and 2x2 inch of stippling to the skin.
The shot was made from very close range - near contact - IMO, with that evidence.
Just driving by now?
Looks like the best thing coming for the State is the Martin family possibly being allowed to identify the screaming as Trayvon's voice, and possibly referring to GZ's early denial that it was his voice that was recorded (if he did in fact deny that it was his; the pundits are claiming that he did).
This, after the Martin family's early vehement denial that the voice was their son's.
They may have to eat those words.
I'm curious as to why Rick Scott felt the need to get involved and name a special prosecutor for this. I doubt he would have felt pressured to do it, was he trying to court the liberal and/or black vote?
If I was on the jury I would ask the judge to bring councils into chambers and ask the prosecution if they have any real evidence or not after the way it ended today because this is getting ridiculous.
Not saying they don't have any but it is entering the realm of the DA needs to be fired IMO...
I believe their claim that he "denied it was his voice" stems from an interview when the investigator played him the 911 call, asked if he heard himself screaming for help as he had told investigators that he had done, and he responded "that doesn't even sound like me."
The voice recognition expert saying that a family member may be the best person to identify the voice is just going to result in Trayvon's mom and Zimmerman's dad both being called to say that it is their child's voice, both sides arguing listener bias (which the defense did a fantastic job getting the state's expert to describe today) has affected the identification, and probably a stalemate in that evidence. And a stalemate is good for the defense.
Good comments, Ben. Thanks for filling in the gaps with the evidence (not watching, I am having to rely on commentary and / or selected media snippets after work - not the whole story).
Doesn't surprise me that GZ may not have recognized his own voice, in distress. I tend to believe his story, i.e., that he was indeed yelling for help when being beaten.
The defense clearly knew that argument was coming, before the detectives were called they had the state's voice recognition expert agree with them that it is possible, and indeed likely, that someone would sound different as a result of the physical and psychological trauma of being pinned down and fearing for your life than they would ordinarily. I think they're setting up to argue in closing arguments (if they think they need to) that of course he didn't recognize his own voice, he's never heard himself screaming for his life when he thought he was being beaten to death before.
I predict that GZ will be acquitted, write a book, make a fortune, divorce his wife and marry Doris Singleton.
so is there any evidence, ie blood splatter, trajectory or ??? that would indicate the positions of gz and tm at the time the shot was fired? i would have thought that the me would define a trajectory....is there a reason it would be omitted or not able to be determined?
