if Aaron Hernandez were to claim he did it is 'self defense'

    if he is determined to have killed the man. And Aaron Hernandez were to claim he did it in self defense, would you say that he should be let off? If Ma. had same laws as Fla regarding use of guns

    Well, the facts of the case would need to substantially change. Wasnt the victim shot execution style? Hard to claim self-defense in that situation.

    Worse for AH, he destroyed his phone, his security system and scrubbed his house. Sure as hell looks guilty of a cover up of a crime.

    events afterwards are events afterwards and could be just panic and not really indicative of guilt of 1st degree murder.

    Aaron could claim they were in a clutch and that he shot the guy in the back of the head as the other guy was trying to choke him.

    If there were no eye witnesses, he could claim he was pissed, carried a gun but only for self defense, and that the other guy came at him.

    who knows at this point in time.

    Question I guess is---at what point does circumstantial evidence outweigh the defendant's 'word' when there is no other witness present at the scene of a shooting done at close distance(kind of hard to claim self defense if it was done with a rifle at long range)

    The other problem is the guy was a friend, not an unknown threat. Not only would he have to overcome the execution style wound, but the fact that he chatted with the guy the day of the murder, met with him, and was his friend. Now he has to explain why he feared for his life after going to hang out with him. Much easier to claim innocence.

    I still want to know what role if any that girlfriend had to do with this. Didn't she disappear for a bit there? My feel is that she was somehow involved, or there was some kind of domestic thing. Either way, what a stupid, foolish thing to do...especially with a newborn. Didn't he tweet a pic of her saying something along the lines of having to do right by her and do the right things? Well this is the exact OPPOSITE.

    If he did his, he needs to man up and admit it and maybe they won't lock him up til he dies (don't think he has prior arrests).

    I'm pretty conservative about jumping to conclusions of guilt in these high profile cases--but it looks pretty damn bleak for AH.

    Naturally I pulled for the guy because he's a Gator--but it seems his UF education, success in the NFL--including a 40 million dollar contract--a relatively new daughter, and a steady girlfried (fiance?)--weren't enough to sever his gangbanger ties/background.

    Just a sad and shameful tragedy, all around.

    Was not aware the ahern was a gang banger- hell, I am not even sure I know what a gang banger is- he was pretty stoic at his arraignment- I would have been scared chitless- but then I doubt I would ever kill someone unless it was truly self defense

    The guy was shot execution style multiple times so self defense is not even in the stratosphere.

    1 deny he killed anyone
    2 if he did kill someone, it was in self defense
    3 if he killed someone not in self defense, it was due to concussions
    4 if he killed someone not in self defense or due to concussions, he was insane

    Worth noting about that Miami case: the vic in that case, was also from CT, and a convicted drug dealer. Also worh noting--he filed his suit before this murder--so it's not like he filed it in response to news of the murder, or to tack on for publicity, or whatever. That one was probably gang related also.

    I guess the answer would be that ANYONE can claim SYG law or self defense. It doesn't mean its applicable or they'll prove it in court. If your trying to relate this in any way to the Zimmerman case, it's a total fail.

    Let me volunteer some more 'hearsay' scuttlebut--with an open invitation to any to feel free and clarify the rec., as I haven't been able to cofirm any of it yet--this is just info. my wife told me she heard reported:

    1. Vic was dating AH's sister's fiance;

    2. Vic and AH were involved in a bar room brawl like 3 nights before the murder;

    3. AH and vic were fighting on same side, against some other dudes;

    4. Sometime between that incident, and the murder, AH heard/saw vic communicating (making nice) with the dudes they fought;

    5. AH was heard as feeling deeply betrayed by vic due to this--which is what the police figured was the motive (again, only makes sense against a gangster background);

    ....I think everyone knows the rest from there.

    Anyone with better info., please feel free to rebut, confirm or clarify. I'm not putting out there as 'fact', rather hoping to get a better grasp on what led up to the shooting/murder.

    Yeah, that's what I was thinking. Nevermind that he is being investigated now in connection with two other unsolved murders according to the Den thread.

    In fact, accepting the premise of the OP, AHern could be looking at the death penalty if this were in Florida. He should consider himself lucky he's in Massachusetts.
