    But how could she have deleted it and not remembered, or not remembered someone unlocking her phone? I thought your story was that she wasn't drunk enough to forget things.

    Not to mention that we have a he said - she said with vested interests on both sides. Building a detailed timeline of all involved seems vitally important. Especially so if you're the state, and your eventual goal will be to break down the defendant's version of the timeline (and that of his witnesses). Of course, that would mean the state was at some point interested in prosecuting, which all indications show was not the case.

    You would have to ask the accuser about memory loss, that is her claim not mine. I have refuted others that have said she was drugged based on the accounts of her friends, the first FSUPD officer on scene and the first TPD officer on scene. But i guess those accounts would also apply to if she were drinking(drunk).

    I may have missed it but I was under the impression that Darby said that he only heard the scooter drive away not see it ( i will go back and look) and it was not at the same time when he spoke with the guard. If you are correct then I agree the guard should have at least been looked at as a witness.

    Edit: found where Darby said he "saw" them ride off on scooter. So yes if he was taking to the guard at the time that should have been followed up. I stand corrected.

    Agreed, I would want to know what Darby and the guard talked about. Why did Darby talk to him in the first place? As soon as I heard about that conversation, I thought it was probably wrong for them not to try to interview the guard.

    I was digging around and found this chart:

    It was said that because the accuser had bruises and injures that it indicated that she was held down.

    The rape kit report identified 2 bruises(1 on right forearm/1 above left knee) It is noted on the chart by the examining nurse that both bruises were "BROWN" in color.

    According to the chart brown bruising indicates a 10-14 day old bruise.

    This would lead to the only "injuries" that were recorded by the attending nurse as 2 areas of mild redness below each knee cap and one area of mild redness on top of right foot.

    Anecdotally, I'd say that chart is wildly inaccurate if it is intended to apply generally. I don't think those ages are consistently accurate, and I know that dark colors can come on within a few hours.

    Although I'd say the "brown" bruises if accurately described are older definitely than the several hour time frame within which she was examined. She easily could have had dark (blue/purple) bruises from this encounter at the time she was examined. The brown described in this chart is a fairly light color. The pictures of the bruises would be useful.

    Yet in one of the police reports, the responding officer (as I recall) or one of the report writers, said that the bruises were turning color in front of them (or words to that effect).

    The chart is used by investigators of child abuse victims. As far as you indicating darker colors can come on quicker, you are correct. On a different page on the same subject, the severity of the damage can influence the color of the bruise. The more damage under the skin as in repeated blows to the same area or a massive one time strike or crush can result in deeper red,blue and purple appearing more rapidly.

    As far as the colors green, yellow and brown. They are colors of the natural healing process.

    you are correct:
    TPD Incident Report-Physical and Emotional Condition of Victim:
    The victim had no obvious signs of injury. She was slightly upset but able to communicate clearly. As the investigation continued several bruises began to appear on victim.

    This along with what the nurse recorded in the rape kit is just one of many conflicting/inconsistent statement/remarks throughout the report.
