    I would hope that this would be the selected course of action. Keep pursuing the issue through the courts in hopes that the victim will finally receive justice.

    I'm still curious about one thing. Her inconsistent testimony sounds like someone under the influence of a drug. When they did a toxicology test, was it done immediately, or did some time lapse before they did it, giving a date rape drug time to disappear?

    Nothing "inconsistent" about her testimony. Memory lapses are commonplace and consistent with the emotional and physical trauma a victim endures during a rape. The fact that Meggs used this to dismiss the case only goes to show how much he has politically invested in this matter because any DA worth his salt knows this.

    From what I understand, there was something up with how long the sample sat.

    Another thing that was brought up was that traumatic events causes memory lapses in some people.

    I don't think so. I believe there was a delay between the tox report, which wouldn't impact anything other than BAC.

    Reading the comments on yahoo and so many people are referring to money. Winston wasn't even named the starter at the time this happened.

    I don't know what happened, but to accuse her of being a "gold-digger" is crazy. There's not gold to dig.

    This should prove interesting. I can only imagine how disgusted they are after Meggs basically made a fool out of her in his clownish press conference. That was a total disgrace.

    How about she take out a domestic violence injunction (aka a "TRO" in other jurisdictions) preventing him from coming within 500 ft. of her, domesticate the injunction in in New York, then hang out at the entrance of the Best Buy Theatre (or wherever the H-man awards venue is this year), and pay a NYPD to be there...when he shows up...

    Bam. Violation of injunction.

    ....off to jail for JW! :)

    TPD waited 40 days to send the blood and urine samples to the lab for testing.

    Some folks have claimed that the rophenol drug degrades over time and is not detectable when you wait that long. I repeated that claim in a couple of earlier posts assuming it true, but I really don't know if that is true, and did a few google searches on the topic but couldn't find anything definitive. Most results focus on how long between the time of drug use/exposure and when the sample is taken, as opposed to how long the sample sits around before being tested.

    My guess is that validity of results may depend at least in part on how the samples are stored. Knowing TPD, they probably left them uncovered on a brightly sunlit window sill... and that would likely have the desired effect of wiping out any trace of date rape drugging.

    As Gray mentioned and other posters have mentioned, apparently just being in a traumatic situation like rape often causes memory loss / disjointed memory like the victim apparently had.

    While I understand the sentiment in terms of sports, I just can't agree due to the severity of the accusation. If I truly believed the accuser's story had no legs to it, I would not want JW charged just to embarrass FSU. I want him charged because I believe the evidence supports a trial. I want it because I've seen better men charged and tried for rape with far less evidence. And I want it because I truly believe we would not even be debating whether or not to charge if he wasn't an important athlete; it would be a no-brainer.

    I guess I am in the minority but from the little I have read the girl was drunk and at least at some point in the night was having consensual sex with Winston. I don't buy the date rap drug potential as it is not likely that Winston has a difficult time getting laid on the Tallahassee campus (ever been there?). He would have plenty of access to ladies without resorting to drugging anyone. If at some point the sex became non consensual and he did't stop then I feel bad for her but this whole things sounds more like post drunk night out remorse and I would hate to see any young mans life ruined based on that, Nole or not. I have two daughters. I hope I have raised them better than to ever be in this young ladies predicament.
