California to give up to 10,000 sexual offenders early release

    Sacramento County Superior Court Judge Allen Sumner’s ruling relates to the state’s recent referendum on Proposition 57 that orders California prisons to consider early parole for non-violent offenders, the Los Angeles Times reported. Brown, a Democrat, had promised voters that non-violent sex offenders would not see the benefits of the bill, but Sumner’s ruling strikes down the exclusion in part.

    Now, those convicted of pimping minors, incest, or child pornography possession are eligible for release.

    “If the voters had intended to exclude all registered sex offenders from early parole consideration under Proposition 57, they presumably would have said so,” Sumner told reporters.

    Sumner ordered that the exclusion be pared down to only affect those currently serving time of a non-violent sex offense, cutting off its effect for future inmates. He also ordered that any sex offender who has served time for their offense but is now serving time for another offense must be eligible for early release.

    So did Brown knowingly allow people that like sharing child pornography and that pimp minors to be excluded in this proposition and the Judge is actually following the law or is there a way the Judge can rule those are technically violent crimes legally.

    This looks really bad on Governor Brown if those crimes can't legally be deemed violent because anything on the ballot like that gets reviewed by multiple lawyers and that can't just have been a mistake.

    Your title is false. The judge said that the state must consider parole for those inmates, not that they will all be released.

    The number could be over 10,000 actually I think so I was actually being conservative. The title is definitely true.

    Rest assured this being California their crazed parole authorities will grant early releases to thousands of crazed sex offenders and place them on the streets with innocent children and other law abiding citizens.

    you really should be able to understand the difference between the judge ordering the state to consider parole and you claiming that California is going to release them.

    “It’s well-balanced,” Brown said. “It’s thoughtful.”

    Although the measure does not define nonviolent crime, Brown’s campaign confirmed that it would apply to any felony not specifically listed in Penal Code Section 667.5.

    Thus, it could benefit felons convicted of what most people would consider to be violent offenses, including assault with a deadly weapon, soliciting murder, intimidating a crime victim or witness, resisting arrest that injures a police officer, violent elder or child abuse, arson with injury, human trafficking, and several forms of manslaughter and rape.

    The forms of rape not considered violent under Brown’s measure include the rape of an unconscious person and that of an unconscious spouse. And therein lies a burgeoning political conflict.

    I guess Brown and his fellow crazed Californians think its alright to parole rapists as long as their victims were unconscious.

    lol This parole Board was going to release crazed people involved in the Manson case and all kinds of other crazed felons. Brown won't intervene in thousands of cases and crazed sex offenders and rapists will be roaming the streets preying on the citizens eventually.

    Take a look at how many Rapist and Pedophiles are REPEAT offenders. I have yet to hear of a REFORMED Pedophile.

    I believe in prison reform for non-violent offenders especially for drugs and vice BUT RAPE, PEDOPHILIA, and HUMAN TRAFFICKING offenders need to be locked away or Castrated.

    Obviously those things are serious crimes and have pretty high recidivist rates, but you cant lock people up indefinitely either (that costs money & space and Cali prisons are massively overcrowded). And in the cases above, all they are doing is considering parole/early release, its no guarantee it will be granted. So, obviously the parole board needs to use their best judgment, because not every sex offender is going to go out and do more crime.

    You could make the same argument about literally any crime committed that involves a victim. Do you want harsher sentences based on the fact that you'd simply be more angry if a crime affected you personally?

    I watch a lot of Cop Shows, Actual cases and I am amazed of how many times their is a criminal with MULTIPLE rape convictions. How is this possible? Again, a little device called an emsculator or an elastrator (elasculator) could solve this problem.

    Nothing is wrong with the title California is to give up to 10,000 or so crazed sex offenders early release.

    This is the same state that had all kinds of sex offenders in past years on supervision running around without GPS monitoring as the law required.

    This is also the same state that let like 1,400 life sentence inmates out on parole in just a few years recently and where a Judge ruled an inmate's volunteer service work behind bars must be considered right up there with what their crime was when making parole decisions essentially saying a crazed sexual offender that did volunteer work in prison and showed a good record behind bars should be considered for release upon the children and other citizens of the state.
