Most conservatives like the idea of healthier us too, but we believe the government shouldn't be making silly overbearing ordinances and lording over us like parents. It's still should be a person's right to make their own decisions in these areas, be they good for us or not. If you want to be stupid then be my guest. I personally don't drink soft drinks of any size, and I don't smoke, and don't eat red meat. etc.,but if you want to, go ahead. I may want to advise you against certain activities, but i'm not going to bring the force of government down on you if you chose otherwise.

Judges that try and dictate their own "social justice" like the judge that overruled the California voters on a state-wide vote on Prop 8? The judge can say, it's this, or that, but in the end it's his/her own social justice that made them rule the way they did.

And to answer you on your definition of activism - not all court cases have a precedent by which to go by, so some judges add their own personal beliefs into their decisions.
