He was in the backseat, the bag was in the front seat near the emergency brake, and he wasn't the one to toss the joint out the window, so hopefully this won't come back to bite him.

I think this will get tossed. Baggie was not even near him; very weak constructive possession case. No admission of ownership by Purifoy. No residue on him. Was not taken into custody; was issued Notice to Appear. It is a weak case, doubt it is even filed on. When I was a prosecutor I would not have filed on a garbage case like this.

Yep, residue on one passenger and another seen throwing it out the window. Nothing incriminating against Purifoy = this one goes away.

I am very much anti-drug, to the point where you should photograph me if I'm holding a beer.
I have always hung out with buddies who did whatever they wanted as long as they didn't force it on me.
But I guess even that attitude doesn't fly anymore? I mean, if one guy smokes, you're now all arrested for possession? Does it even matter whose car it is?
