Default Legal advice

Neighbor parks their car on street along my property line (without my permission) with passenger tires on my grass (without my permission). A baseball from my backyard sails over fence and dents neighbor's car. From a legal standpoint, am I responsible for paying for repairs?

Couldn't answer your question but I would bet from the way you describe the way the car is parked he is not parking on your property. That first 5 or 10 feet of grass you are mowing probably belongs to the city/county.

Yep, the right of way is where he's parking. I told a subcontractor once to quit parking on the neighbors lawn. He proceeded to tell ne he was parking on city propertyy since it was the r.o.w. I promptly told him he was fired. Noone else has done it since. Lol.

Depends on how the baseball was propelled. Most likely not. If he wants you to repair it and you don't think you should then tell him to fix it himself. If he sues you then after the judgement you will know the answer to your question. You could always turn it over to your homeowner insurance company to handle. I would not do that over a dent in most cases, but thats just me.

you are liable. Doesnt matter whether you view the car as being legally parked or not. Look at it this way...say he was parked right smack in the middle of your yard. You then take about 20 swings of a baseball bat to his car. Are you saying you wouldnt be liable for the damage? Thats not how it works.
