The NCAA on Monday released the results of an external probe of how it investigated the Hurricanes, nearly a month after revealing what it called "a very severe issue of improper conduct." That issue was that the attorney for former booster and convicted Ponzi scheme architect Nevin Shapiro was used to improperly obtain information.

However, the NCAA said the case against Miami will proceed "with information properly obtained by the enforcement staff."

The NCAA admitted missteps were made. Miami had no immediate comment.

And now that this step is complete, the path is clear -- again -- for Miami to finally receive its notice of allegations from the nearly 2-year-old investigation into what rules were broken within athletics.

They play football in the ACC isnt that punishment enough. They should ask there conference member FSU who had one loss for several weeks and still were ranked behind several two loss SEC schools in the BCS standings..

Slap on the wrist as usual. If I were running the NCAA enforcement arm, I would have issued the following death penalties. USCw, (Bush "indescretions") tosu, (tatgate) UM (ponzi scheme nude bars coverup)....Penn State (freako)....or what would be even better is put them on a 10 year probation to where they could still field a team but couldn't offer ANY scholarships.

OMG! I Don't understand how people can fall for that stuff, but otoh, I guess it can frighten you when you're up against something. i feel for you man, that's a tough situation. You can kiss the $$'s goodbye, just try and see if your experience will help keep someone else from falling for it.

NCAA enforcement shouldn't be going after anyone as of now. Need to be dismantled before these kind of situations are looked into again. Emmert isn't the one who should be overseeing this stuff.

Who cares if the NCAA got the info by improperly using an attorney for the criminal. The NCAA isn't an government entity, this isn't a court of law. If scUM players, coaches, boosters, etc. violated the rules of the "Association" and gained an unfair advantage in doing so, fry them.

They cheated and should be punished accordingly.

I agree...you don't have to participate as a member of the NCAA as an instituition if you don't want. UM should just withdraw as a member from the NCAA and focus on education if they don't like the way the NCAA handles things otherwise stop cheating to get a competitive advantage and then deflect what you did because you don't like how the NCAA got the information. The NCAA's true authority is being tested right now and they can't back off otherwise they are powerless.

So you guys are in favor of a corrupt organization hammering a corrupt program? I'm all for cheating teams getting theirs, but not at the hand of the current NCAA leadership. Its shortsided to think otherwise. I understand the hate of UM, they obviously cheated and should be punished.

There are numerous major media members calling for the disintegration of the NCAA and the removal of Emmert. Can't Miami wait until we have competant leadership/investigators? Seems to me the only people willing to overlook the corrupt NCAA are the rival schools of Miami. New NCAA leadership doesn't mean Miami is off the hook.

Funny how now duh U and South Florida Media is contending that the NCCA is corrupt and broken, They say this after they are caught and it’s now obvious to anyone that can add two and two and come up with four that UM has been cheating for the past 3 or 4 decades. Ever since the 80 they have been operating at an advantage while UF was serving its sentence under NCAA sanctions Miami was winning NC and not complaining at all about the way the NCAA operated. Now that it’s them they cry the system is broke and should be scrapped ….. Hell no, I have read the 52 page report the NCAA released and what it reveals is that the enforcement committee is newly formed Under a new Commissioner and while well conceived the working parts are not communicating and following all the proper protocol . This will improve over time but don’t be fooled by those that say we need to throw the baby out with the bathwater. This morning I was listening to ESPN sport radio and after hearing their take on things I thought that Mark Emmert should step down, but that was before I read the 52 page document released by the NCAA it takes some time and there is a lot of legalese but in reading it I could see where the break downs occurred in the process. Basically , there was one rouge investigator who after the NCAA’s legal department had ruled it was a conflict of interest to pay Perez (Shaprio’s attorney ) he did it anyway and lied to his boss about it being approved. His boss should have back tracked and confirmed it but did not, anyway they have both been fired. The thing that has so frustrated me is that the focus of the investigation was directed away from The University of Miami who has been cheating and getting away with it for decades. Today the NCAA has ruled that only 20% of the evidence collected will be inadmissible so that leave the other 80% that the Cains are going to be accountable for and that should be enough to sink that stinking bunch of SCUM bags for the next decade, but we will see ……

Are you suggesting that the case agaisnt scUM should be dropped?

This makes me think of the case against Galen Hall. The NCAA had no evidence of wrong doing with Hall paying Williams' child support, although there was circumstantial evidence of such (sealed envelope). The two people that knew, admitted nothing. Since there appeared to be wrong doing, UF was sanctioned.

I have no sympathy for scUM; hammer away.

This makes me think of the case against Galen Hall. The NCAA had no evidence of wrong doing with Hall paying Williams' child support, although there was circumstantial evidence of such (sealed envelope). The two people that knew, admitted nothing. Since there appeared to be wrong doing, UF was sanctioned.

Did you not read the last sentence of BOTH paragraphs? I absolutely don't think this. Just think we should have a competent enforcement body at the head of this. Then Miami can get whats coming to them.

My best case analogy brings me back to childhood when one kid had a basketball court in his backyard and guess what...you played by his rules even if you thought they were bogus or you went home and didn't play ball. Same for UM, play by the NCAA rules or quit and go home. After all, college sports is a privilege not a god given right...too bad if you don't like how the NCAA found out about your cheating.

STATEMENT FROM UNIVERSITY OF MIAMI PRESIDENT DONNA E. SHALALA ON NCAA NOTICE OF ALLEGATIONS

“The University of Miami deeply regrets and takes full responsibility for those NCAA violations that are based on fact and are corroborated by multiple individuals and/or documentation. We have already self-imposed a bowl ban for an unprecedented two-year period, forfeited the opportunity to participate in an ACC championship game, and withheld student-athletes from competition.

"Over the two and a half years since the University of Miami first contacted the NCAA enforcement staff about allegations of rules violations, the NCAA interviewed dozens of witnesses, including current and former Miami employees and student-athletes, and received thousands of requested documents and emails from the University. Yet despite our efforts to aid the investigation, the NCAA acknowledged on February 18, 2013 that it violated its own policies and procedures in an attempt to validate the allegations made by a convicted felon. Many of the allegations included in the Notice of Allegations remain unsubstantiated.

"Now that the Notice of Allegations has been issued, let me provide some context to the investigation itself:

> Many of the charges brought forth are based on the word of a man who made a fortune by lying. The NCAA enforcement staff acknowledged to the University that if Nevin Shapiro, a convicted con man, said something more than once, it considered the allegation “corroborated”—an argument which is both ludicrous and counter to legal practice.

> Most of the sensationalized media accounts of Shapiro’s claims are found nowhere in the Notice of Allegations. Despite their efforts over two and a half years, the NCAA enforcement staff could not find evidence of prostitution, expensive cars for players, expensive dinners paid for by boosters, player bounty payments, rampant alcohol and drug use, or the alleged hundreds of thousands of dollars in cash and gifts given to student-athletes, as reported in the media. The fabricated story played well—the facts did not.

> The NCAA enforcement staff failed, even after repeated requests, to interview many essential witnesses of great integrity who could have provided first-hand testimony, including, unbelievably, Paul Dee, who has since passed away, but who served as Miami Athletic Director during many of the years that violations were alleged to have occurred. How could a supposedly thorough and fair investigation not even include the Director of Athletics?

> Finally, we believe the NCAA was responsible for damaging leaks of unsubstantiated allegations over the course of the investigation.

Let me be clear again: for any rule violation—substantiated and proven with facts—that the University, its employees, or student-athletes committed, we have been and should be held accountable. We have worked hard to improve our compliance oversight, and we have already self-imposed harsh sanctions.

We deeply regret any violations, but we have suffered enough.

The University and counsel will work diligently to prepare our official response to the Notice of Allegations and submit it to the Committee on Infractions within the required 90-day time period.
