Once again, the lawyer of the day award goes to someone in Jersey. And people here wonder why more fled NJ last year than any other state. It can't be all of the frivolous lawsuits against businesses. Nah.

Two New Jersey men sued Subway this week, claiming the world's biggest fast-food chain has been shorting them by selling so-called footlong sandwiches that measure a bit less than 12 inches.
The suit, filed Tuesday in Superior Court in Mount Holly, may be the first legal filing aimed at the sandwich shops after an embarrassment went viral last week when someone posted a photo of a footlong and a ruler on the company's Facebook page to show that the sandwich was not as long as advertised.
At the time, the company issued a statement saying that the sandwich length can vary a bit when franchises do not bake to the exact corporate standards.
Stephen DeNittis, the lawyer for the plaintiffs in the New Jersey suit, said he's seeking class-action status and is also preparing to file a similar suit in Pennsylvania state court in Philadelphia.

being from NJ myself and having lived in FL for a long time now, I would say that Florida is many times more crazy, ridiculous, stupid, etc...

this is why we teach our cashiers to say medium or large- a medium is about 8 inches and a large is about 12 inches-but our sub rolls are hand made and they will have different sizes at times

I'm not that familiar with Subway and their advertising campaign. Have they ever declared that their "foot long" is intended to mean 12 inches? The more common definition of "foot" is the part of the body which very clearly varies in length from one person to the next. It seems like the ambiguity was intended for reasons such as this.

This is the kind of national priority that gives us a second term. Who gives a damn I'd their "foot long" is 11"? Food sizes and portions are always approximate. I joke that at Starbucks, "venti" is Italian for "nineteen". Every 14" inch pizza you order with a handmade crust, could be over or understretched by ad much as an inch. Your 6oz filet may be 5.7oz or 6.2oz.

Yep, if I'm going to get a sub thats the last place I'm going. Perhaps they heard this subway news elsewhere about this and decided they would try an easy lawsuit

Stupid. Complain about it to Subway if you want, but suing over this is dumb.
If you go back to science class, there is a different level of precision in different terms.
That is that 12" (dividing it into 12 parts) is a more precise term than "foot". Maybe the defense can go there.

Publix is very good, but the best Italian I've ever had was a a Philly/NJ-type show in Pompano Beach called LaSpadas. Sublime.

I like Jersey Mike's okay, I like Jimmy John's. Kinda meh about Quiznos or Larry's. Subway may slot in above a couple because of consistency.

Yeah, if you like consistently unimpressive.
I do like Firehouse for hot subs on the run. But I'm the same with subs as pizza. I know there's a local, independent guy who does it better than the chains and, if I have time, I will seek out those kinds of places.

I am a native Floridian who lived in NJ for about 14 years. Despite it's small geographical size it has a lot of different areas, customs, people, etc. During my time there I found the people nice and pleasant to be around. Some of the best, nicest people I know I met in New Jersey. However, it is "different" than the south, for sure.
This lawsuit is beyond ridiculous. And wasteful.

That being said, who the hell eats at subway anymore? Firehouse is where it's at.
Subway is basically bottom of the barrel in terms of taste but is so much cheaper than most options that it becomes attractive. Firehouse is good but expensive.

Having practiced law for 38 years, I can tell you that the vast majority of lawyers would not represent someone in a case such as this. I would not consider it, and would rather make a modest salary than take on a case such as this.
Recall that juries composed of different kinds of people (young, old, male, female, highly educated, less highly educated, professional, white collar, African American, white, etc.) make the decisions. Lawyers do not.
What person does not seek to maximize his or her earning potential?
